Terms of Service

Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of Qalatra’s paid, hosted services — including the Qalatra web application, our published mobile apps, and Qalatra Fleet servers (together, the “Services”). By creating an account, subscribing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms cover the paid Services only. The open-source Qalatra desktop application, which you can run entirely on your own machine and your own backend, is provided free under its open-source license and is not governed by these Terms.

Accounts

To use the paid Services you must create an account. You agree to provide accurate information, keep it current, and keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a subscription.

Organizations and seats. A paid plan is purchased by an organization and can include one or more seats. The organization’s administrators may invite members and assign or reassign seats. A member is entitled to the paid Services only while they hold an assigned seat on an active subscription.

Subscriptions, billing, and payments

The paid Services are offered on a recurring subscription basis (for example, monthly). Fees, billing intervals, and any per-seat pricing are shown at the point of purchase.

Payment processing (Stripe). We use Stripe, Inc. as our third-party payment processor. When you subscribe, your payment card and billing details are collected and processed by Stripe under Stripe’s terms and privacy policy. We do not store your full card number on our servers. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis for the plan and quantity you select, plus any applicable taxes, until you cancel.

Renewals and changes. Subscriptions renew automatically at the end of each billing period at the then-current price. If we change pricing, we will give you notice before the change applies to your subscription. If a charge fails, we may retry it and may suspend or downgrade access until payment succeeds.

Cancellation and refunds

You may cancel at any time — from the web app, the mobile app, or your billing settings. When you cancel, your subscription remains active through the end of the current paid billing period, and you will not be charged again. Access ends when that period expires.

No retroactive refunds. Because the software and Services are made available to you immediately, payments are non-refundable. We do not provide refunds, credits, or pro-rated amounts for partial billing periods, unused time, or charges already incurred. Cancelling stops future charges; it does not refund past ones.

Fleet servers. The same policy applies to Qalatra Cloud server subscriptions: you may cancel at any time and amounts already charged are non-refundable. A cancellation may suspend server access and creates an operator-reviewed teardown request; it does not trigger immediate automatic deletion. You are responsible for exporting or migrating data you wish to keep before teardown is approved, after which the server and its data may be permanently deprovisioned.

Acceptable use

You agree not to use the Services to:

break the law; infringe others’ rights; attempt to gain unauthorized access to the Services or other users’ data; interfere with or disrupt the Services or their infrastructure; resell or sublicense access without our permission; or use Fleet servers to host malicious, abusive, or unlawful content. We may suspend or terminate accounts that violate these Terms.

Your data and content

You retain ownership of the content and data you create or store through the Services. You grant us only the limited rights needed to operate and provide the Services to you (for example, to store, back up, and transmit your content). We do not sell your content. Our handling of personal information is described in our Privacy Policy.

Service availability and disclaimers

We work to keep the Services reliable, but they are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any data will never be lost.

Limitation of liability

To the fullest extent permitted by law, Qalatra and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose.

Termination

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or fail to pay. On termination, your right to use the paid Services ends, subject to the cancellation and refund terms above.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
